Repealed the Royal Decree 202/2000, laying down the rules for food handlers

It shifts the responsibility of the formació to food business operators

With the approval of this Royal Decree 109/2010 of 5 February was deleted two essential elements of it that conflicted with the Services Directive: prior administrative approval by the competent authorities (in general, communities autonomous) of training institutes for food handlers and programs to provide for such entities. Thus, to ensure the goals pursued by such authorization, following the provisions of Regulation (EC) No 852/2004 of the European Parliament and Council of 29 April 2004 on the hygiene of foodstuffs, which in Annex II, Chapter XII, which includes among the obligations of food business operators, to guarantee “the supervision and instruction or training of food handlers in food hygiene matters” transfers the responsibility for training from the competent authorities to food business operators, who must certify, on official inspection visits that companies handlers are trained in the tasks assigned.
